§ 1 Scope
These Terms and Conditions apply to all orders placed via postcard.app. The contracting party is PostCard GmbH (in formation), Musterstraße 1, 12345 Musterstadt, Germany.
§ 2 Conclusion of contract
The purchase contract is concluded as follows: 1. You design a postcard and place your order. 2. After successful payment, you will receive an order confirmation by email. 3. The contract is concluded upon receipt of the order confirmation.
§ 3 Prices and payment
The price per postcard is: • €4.99 (incl. VAT) for EU delivery • $4.99 (incl. taxes) for USA/Canada delivery Payment via Stripe (credit card, Apple Pay, Google Pay). The amount is charged immediately after ordering.
§ 4 Delivery
Delivery times (from start of printing, approx. 24h after payment): • EU: 3–7 business days • USA / Canada: 3–5 business days • Worldwide: 5–14 business days These are estimates. PostCard is not liable for delays caused by the postal service.
§ 5 Right of withdrawal
Since postcards are individually manufactured to your order, there is no right of withdrawal pursuant to § 312g para. 2 no. 1 BGB (German Civil Code). Exception: For proven print errors or damage, you will receive a free replacement or refund. Please contact us within 14 days of receipt.
§ 6 Content and copyright
You are responsible for: • The legality of the uploaded photo (you hold all required rights) • The content of the message (no illegal, offensive, or pornographic content) PostCard reserves the right to reject orders with impermissible content.
§ 7 Limitation of liability
PostCard is liable without limitation for intent and gross negligence, as well as for damages resulting from injury to life, limb or health. For slight negligence, PostCard is only liable for breach of essential contractual obligations.
§ 8 Applicable law
German law applies. Place of jurisdiction for merchants is Musterstadt.
